The Lassen County Board of Supervisors convene in Regular Session at 9:05 a.m.  Chairman Pyle asks for public comment and no comments are received.  County Clerk Nagel announces the Closed Session items and the Board recesses to Closed Session at 9:07 a.m. for:   

 

1)  Conference with Legal Counsel:  Existing litigation pursuant to Subdivision (a) of Government Code Section 54956.9: Case Number CPF 06-506171 Joseph Holder, et al. v Bruce McPherson, as California Secretary of State, et al.

 

2)  Conference with Labor Negotiator John Ketelsen:  May include the following bargaining units - a) Lassen County Peace Officers Assn. (LCPOA),  b)  United Public Employees of California (UPEC) c) Lassen County Road Workers Assn. (LCRWA), d) Mid-Management, e) Lassen County Peace Officers Assn. Management Unit (LCPOAMU), and f) Management.

 

3)  Employee performance evaluation:  Child Support Director Beth Hyde.

 

Present in the Closed Session are Supervisors Robert Pyle, Lloyd Keefer, Brian Dahle, and Jack Hanson; County Counsel Craig Settlemire, County Administrative Officer John Ketelsen, Child Support Director Beth Hyde and County Clerk Theresa Nagel.  Beth Hyde departs at 9:13 a.m.  Deputy County Counsel Traci Witry and County Clerk-Recorder Elect Julie Bustamante enter at 9:14 a.m.  Supervisor Chapman enters at 9:31 a.m.  Personnel Director Ron Vossler enters at 9:33 a.m.  Julie Bustamante departs at 9:33, Traci Witry departs at 9:34 a.m.  Closed Session is recessed at 9:51 a.m.

 

The Lassen County Board of Supervisors reconvenes in Regular Session on Tuesday, August 22, 2006, at 9:56 a.m.   Present:  Supervisors Robert Pyle, Jim Chapman, Lloyd Keefer, Brian Dahle, and Jack Hanson; County Counsel Craig Settlemire, County Administrative Officer (CAO) John Ketelsen and County Clerk Theresa Nagel.  Following the flag salute, the invocation is offered by Supervisor Keefer.

 

ANNOUNCEMENT OF ITEMS DISCUSSED IN CLOSED SESSION

The County Clerk announces the Closed Session dealt with:

 

1)  Employee performance evaluation:  Child Support Director Beth Hyde - on motion by Supervisor Keefer, seconded by Supervisor Hanson and carried, with Supervisor Chapman absent, an excellent evaluation is given. (Beth Hyde departs; Deputy County Counsel Traci Witry and County Clerk-Recorder Elect Julie Bustamante enter.)

 

2)  Conference with Legal Counsel:  Existing litigation pursuant to

AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS

Supervisor Keefer requests the meeting be adjourned in memory of Mattie Redwine.  County Clerk Nagel received a request to move Items G-5 and G-7, parcel maps, to a future agenda.

 

It is moved by Supervisor Dahle, seconded by Supervisor Keefer and carried to approve the agenda with the noted changes.

 

PUBLIC COMMENT

1.         Michele Davenport speaks about her chemical sensitivity that developed after she was an adult (has asthma) and how the mosquito spraying has affected her.  She displays mosquito dunks that she uses around her rural property and suggests measures such as this be used rather than spraying.  Also speaks of the warning about cleaning outdoor furniture and toys following mosquito spraying and asks who will wash off playground equipment in sprayed areas.

2.         Agricultural Commissioner Ken Smith provides updated information on mosquito samples, three of which have tested positive for West Nile Virus (WNV).  The State Department of California Department of Health Services has found that WNV is widespread in lower elevations of Lassen County.  He notes that Banner Lassen Hospital has received no reports of illness due to the spraying and neither has the Poison Control Center.  He feels the situation warrants more areas being treated and wants the board members to consider holding an emergency meeting to consider a request for further spraying. 

3.         Marlene Schmidt states that she took a survey of 12 - 15 people who have gotten ill from spraying.  She asks Mr. Smith if he received any calls about illness.  Mr. Smith responds that he received three calls:  one lady started getting ill at 11:00 p.m. but the spraying did not begin until 11:10 p.m.; a child was reported as becoming ill on August 13th, but the spraying started on August 17th.  He states there needs to be stand
