The Lassen County Board of Supervisors convene in Regular Session at 9:03 a.m.  Chairman Pyle asks for public comment and no comments are received.  County Clerk Nagel announces the Closed Session item and the Board recesses to Closed Session at 9:04 a.m. for:  Conference with Legal Counsel:  Existing litigation pursuant to Subdivision (a) of Government Code section 54956.9: California Farm Bureau Federation et. Al. v California Wildlife Conservation Board, et. Al. Case No. CV22294/CV22756.

   

Present in the Closed Session are Supervisors Robert Pyle, Lloyd Keefer, Brian Dahle, and Jack Hanson; County Counsel Craig Settlemire, Risk Manager Ron Vossler and County Clerk Theresa Nagel.  Supervisor Chapman and CAO Ketelsen are absent, Supervisor Hanson enters at 9:05 a.m.  Closed Session is recessed at 9:25 a.m.

 

The Lassen County Board of Supervisors reconvenes in Regular Session on Tuesday, March 21, 2006, at 9:31 a.m.   Present:  Supervisors Robert Pyle, Jim Chapman, Lloyd Keefer, Brian Dahle, and Jack Hanson; County Counsel Craig Settlemire, and County Clerk Theresa Nagel.  County Administrative Officer (CAO) Ketelsen is absent.  Following the flag salute, the invocation is offered by Supervisor Dahle.

 

ANNOUNCEMENT OF ITEMS DISCUSSED IN CLOSED SESSION

The County Clerk announces the Closed Session dealt with a conference with Legal Counsel:  Existing litigation pursuant to Subdivision (a) of Government Code section 54956.9: California Farm Bureau Federation et. Al. v California Wildlife Conservation Board, et. Al. Case No. CV22294/CV22756 - no reportable action taken.

   

AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS

Supervisor Hanson requests the meeting be adjourned in memory of Henriette Hagata Alway who was born in Willow Creek Valley April ll, 1920.

 

It is moved by Supervisor Keefer, seconded by Supervisor Hanson and carried to approve the agenda with the noted change.

PUBLIC COMMENT

1.         Fair Manager Jim Wolcott distributes the Manager Report and announces the Fair Advisory Board took action to remove the rodeo structures from the main arena.

2.         Agriculture Commissioner Ken Smith announces that State Secretary of Agriculture A. G. Kawanura will be here for a Weed Tour on July 19th, 20th and 21st.

3.         Jack Pastor provides new information on Granite Fox Coal-Fired Power Plant:  the parent company Sempra has withdrawn all financing; Nevada has placed all permits on hold; the Federal Appeals Court threw out an Environmental Protection Agency rule that would have loosened the way the government regulates air pollution from coal-fired electric power plants. He asks if Lassen County is willing to sacrifice clean air so Los Angeles can turn on another air conditioner.

4.         Rob Hill representing Lassen Sportsmans Club presents a letter requesting co-sponsorship of the Junior Fishing Derby by providing insurance for the event and he thanks the board members for their generosity in contributing to the Junior Fishing Derby.

 

UNAGENDIZED BOARD REPORTS

1.         Supervisor Chapman reports on the Fair Advisory meeting and states this is a great group.

2.         Supervisor Keefer reports on the Economic Development Coordinating Council meeting - good attendance and received good report from the City of Susanville relating to grants and loans; discusses a letter from Mr. Wosick that mostly dealt with what his facility has contributed to economic development which has been substantial and also gets into the issue of the continued monitoring and the use permit - Supervisor Keefer does not believe he has reimbursed the county for the cost of monitoring and states there was also no mention that the monitoring is because of a court order - he will answer the letter; discusses the continuing saga of moving the horse arena at the Janesville Park and notes there is a group trying to get the matter resolved and this may occur before the end of the week, but he wants it placed on the next agenda in case it is not resolved.

3.         Supervisor Dahle reports on the RCRC meeting at which discussions of the Counties/Schools Funding Legislation were held; attended the Big Valley School District meeting and urged them to support the Counties/Schools Funding Legislation and send a representative to the Counties/Schools Coalition Conference in Reno.

4.         Supervisor Hanson further reports on the Economic Development Coordinating Council meeting, stating the report on grants and loans by the City of Susanville was very good and a good report was presented on the Groundwater Management Plan - also comments from Heidi Perry on wind energy power facilities; requests a letter to Congressman Doolittle be placed on the next agenda regarding railbanking.

5.         Supervisor Pyle will meet tomorrow with Dyer Mt. Associates for an update.

 

CONSENT CALENDAR

Supervisor Chapman requests that Item G-5, agreement with Lassen College, be removed from the consent calendar for separate consideration.

Authorize the Director of Lassen WORKS and Community Social Services to send a letter to the California Department of Social Services, Food Stamp Branch, not requesting a waiver of Able-Bodied Adult Without Dependents (ABAWD) Program requirements, thereby, not participating in waiving the program requirement.

 

PUBLIC WORKS DEPARTMENT ITEMS

Adopt Resolution No. 06-016, to approve Parcel Map Waiver #2002-27, Eades.

 

Award bid to Larimer-Surian Construction, Inc., Janesville, the lowest bidder meeting specifications, in the amount of $5.49 per ton (not to exceed 15,000 tons or $88,320.38) for 1 1/2" Class 2 Aggregate Base.

 

TREASURER/TAX COLLECTOR ITEM

Receive and file Treasurer's Investment Report for February, 2006.

 

PRISON TRIALS COST REIMBURSEMENT PROGRAM ITEMS

Receive and file Recaps of CCC Prison Trials Cost Reimbursement Billing for the months of July 2005 through February 2006 and High Desert State Prison Trial Costs Billing for the months of July 2005 through February 2006.

HEALTH & SOCIAL SERVICES - COMMUNITY SOCIAL SERVICE / LASSEN WORKS

Supervisor Chapman states the agreement with Lassen Community College for Independent Living Skills Training for 2006 does not show how much the class attendees will generate in additional revenue to the college - he wants the full picture.

 

It is moved by Supervisor Chapman and seconded by Supervisor Hanson to approve and authorize the CAO to sign an agreement with Lassen Community College for Independent Living Skills Training for 2006.

 

Deputy CAO for Health and Social Services Kevin Mannel provides further information on this program.  Supervisor Hanson points out the agreement shows Lassen College as "a private, non-profit corporation" and he wonders if the agreement is with the College District or with the College Foundation. 

 

Supervisor Chapman withdraws his motion and requests staff to further look at this agreement and submit it on the next agenda - the second concurs.  Supervisor Chapman wants to be sure we are dealing with the College District and not the College Foundation and also wants to know what the attendees will generate in additional revenue.

 

LASSEN COUNTY CHILDREN & FAMILIES COMMISSION

It is moved by Supervisor Chapman, seconded by Supervisor Dahle and carried to appoint Supervisor Brian Dahle as Board Member and Supervisor Jim Chapman as Alternate on the Lassen County Children & Families Commission.

 

ADMINISTRATIVE SERVICES

Assistant to the CAO Julie Morgan provides a brief history of the process leading to the request for vehicle replacements.  She notes that vehicle #8520 for Lassen Works will not be paid for out of Fleet Maintenance money as this vehicle was purchased with State Funds - another funding source will have to be found.

 

It is moved by Supervisor Chapman, seconded by Supervisor Hanson and carried to authorize the purchase through State Department of General Services of fleet replacement vehicles:

Mental Health  (7102) replacement - compact sedan, $11,010.00;

Lassen Works (8520) replacement - 7 passenger mini van, $14,703.00;

Lassen Works (8511) replacement - 7 passenger mini van AWD, $25,398.00;  Juvenile Hall (5604) replacement - 7 passenger mini van AWD, $25,398.00;

                       

Authorize the purchase from Salt Lake County Fleet Sales:

Jail Transport (5305) replacement - sedan, $16,900.00.

Total cost with sales tax and freight would be about $100,493.87 and purchase would come from Fleet Maintenance Budget 135-0352-3006200 with the exception of vehicle #8520 which must be paid from another funding source.

 

PUBLIC HEARING  - VARIANCE #2005-165, THOMPSON

The public hearing is opened at 10:16 a.m. to consider Variance Request #2005-165, George Thompson, to vary from the rear yard setback requirements of the County Zoning Ordinance (from 20 feet to 5 feet) to allow placement of a residential photovoltaic solar array.  The project site is zoned R-1-B (Single Family Residential, Building Site Combining District) and is located at 666-780 Spring Creek Drive, Clear Creek. A.P.N.: 123-076-13.

 

Planner Joel Rathke presents the staff report.  No one speaks in opposition to or in favor of the variance and the hearing is closed at 10:18 a.m.

JOHNSTONVILLE (TOAD TOWN) PARK DRAINAGE

Supervisor Keefer provides information on water that has accumulated on the Johnstonville Park property from drainage off the CalTrans property and Diane Drive.  CalTrans has proposed placing a culvert to drain the property.

 

It is moved by Supervisor Keefer, seconded by Supervisor Hanson and carried to authorize the Chairman to sign a letter requesting CalTrans consider funding the construction of a drainage system to direct surface waters away from Johnstonville Park.

 

BUREAU OF LAND MANAGEMENT

Field Manager Dayne Barron states it is expected the Resource Management Plan Draft will be released by late April for a 90-day public review period.  As a cooperating agency, the county has already received three binders of the documents.  Public meetings will probably be held the last week of May or the first week of June.  The Preferred Alternative presented to the Board two years ago has not been changed. 

 

Bizz Johnson Trail Tunnel Closure - tunnel was closed due to concern about rockfall through a failed portion of the roof about 200 feet into the tunnel.  A partnership with Sierra Army Depot resulted in a temporary solution to allow the tunnel to be open for the Bizz Johnson Marathon.  The tunnel is still closed and BLM engineers have estimated a repair cost of $50,000.  Lassen Land and Trails Trust has set up an account for private donations to repair the tunnel.

 

Prescribed Burns Update - the Northeast Air Alliance, which includes representatives from federal, state and private industry entities who conduct prescribed burning and air quality officials in Butte, Lassen, Modoc, Plumas, Shasta, Siskiyou and Tehama counties met twice to discuss improving the coordination and measures to mitigate smoke impacts.  A new operating plan, and smoke  management plan format was developed and were finalized on March 8th.  These documents should improve communications between prescribed burners, fire weather forecasters, air resources board officials, and public affairs specialists to share information on burn projects, disseminate critical weather and smoke management information, and identify smoke sensitive areas and community events that could be impacted by smoke from prescribed burns.  An essential addition to the operating plan is the development of public education and awareness strategies to better inform and communicate with the public.  The Operating Plan and Smoke Management Plan will be required for Wildland Fire Use events as well as prescribed burns. 

 

Supervisor Keefer notes that Dayne is the person that got all the agencies together on the controlled burn smoke issue and everyone thanks him for that effort.

 

Discussion is held on the possibility of the Bizz Johnson Trail Tunnel Project receiving funding through the RAC - it is noted the current RAC Award Period has ended and funding would have to wait for the next round of funding.

U.S. FOREST SERVICE

RAC Coordinator Heidi Perry distributes information on the 2005 and 2006 RAC Proposals. 

 

2005 RAC - Eighteen proposals awarded $542,772 out of $581,455 and leveraged another $424,461 in Lassen County for a total of $967,233.  Funds contributed by SIR, BLM, County, State (OHV) and private landowners.

 

2006 RAC - Fifteen proposals awarded $469,495 out of $594,829 and leveraged another $217,833 in Lassen County for a total of $687,328.  Funds contributed by SIR, BLM, County and private landowners.

 

Other projects in Lassen County through the National Fire Plan 2003-2004 generated $408,000 and for 2005-2006 generated $558,000.

 

Three million dollars were generated in 2003-2004 through partnerships with RAC, NFP, S&PF for Lassen County; and for 2005-2006 $1.8 million was generated with RAC for Lassen County.

 

2006 National Fire Plan - projects in California alone, the State Fire Safe Council received 284 proposals and funded 107 with $7.4 million between BLM and Forest Service Community Protection Program - 44 were awarded in the Sierra Region which equal 40% of the funding for 2006.

 

Ms. Perry provides an update on the Creeks Forest Health Recovery Project - Forest Service has been sued by Sierra Nevada Protection Campaign. 

 

Supervisor Chapman wonders about Frank Stewart's proposal to get these groups to pay for court costs when they lose the lawsuits.
