1.                   10:15 a.m.:  PUBLIC HEARING - USE PERMIT #2005-108, FERGUSON (SUNNYSIDE HOMES)

SUBJECT: Use Permit #2005-108, Ferguson.  Appeal of the Planning Commission's approval to allow for a second dwelling for family members on a 75 acre parcel.  The appeal was filed by the Minch, Bowden and Vacher families who reside near the project site.  The project site is located approximately 500 feet north of Center Road at 476-550 Juniper Ridge Road, Standish.

ACTION REQUESTED: 1)   Hold a public hearing on the appeal;

2)   Act on the appeal within 10 days of the hearing.

2.                   10:30 a.m.:   PUBLIC HEARING - REZONE AND AGRICULTURAL PRESERVE #2005-145,  DEFOREST

SUBJECT: Rezone and Agricultural Preserve #2005-146, proposal by Paul & Karin Deforest to rezone 4,862 acres of land from U-C-2 (Upland Conservation/Resource Management District) to E-A-A-P (Exclusive Agricultural, Agricultural Preserve Combining District) in association with a Williamson Act Contract.  The subject land is located 13 miles southeast of Adin on the west side of Spooner Road.

ACTION REQUESTED: 1)   Receive the Planning Commission's recommendation on rezoning;

2)   Conduct a public hearing pursuant to County Code Section 18.124.050;

3)   Introduce and adopt, by title only, the Ordinance implementing the rezone of the 4,862 acres of property from U-C-2 to E-A-A-P.

4)   Receive the Land Conservation Committee recommendation on the establishment of an agricultural preserve;

5)   Adopt Land Conservation Committee findings;

6)   Adopt resolution establishing an agricultural preserve and authorize the execution of a Williamson Act Contract. (074)

3.                   10:40 a.m.:   PUBLIC HEARING - REZONE AND AGRICULTURAL PRESERVE #2005-144, RULISON

SUBJECT: Rezone and Agricultural Preserve #2005-144, proposal by Craig Rulison to rezone 1,117 acres of land from U-C-2 (Upland Conservation/Resource Management District) to E-A-A-P (Exclusive Agricultural, Agricultural Preserve Combining District) in association with a Williamson Act Contract. The subject land is located 16 miles southeast of Adin on the west side of Spooner Road.

ACTION REQUESTED: 1)   Receive the Planning Commission's recommendation on rezoning;

SUBJECT: Public hearing to consider adopting Resolution of Application to Local Agency Formation Commission of Lassen County requesting proceedings to form a Recreation and Park District.

ACTION REQUESTED: 1)   Hold public hearing pursuant to Public Resource Code section 5782.5 to consider adopting Resolution of Application to Local Agency Formation Commission of Lassen County (LAFCO) requesting proceedings to form a Recreation and Park District.  (076)

2)   Consider introducing an Ordinance Imposing a Transactions and Use Tax to be administered by the State Board of Equalization.

COUNTY CLERK ITEM

1.                   MINUTES

SUBJECT: Minutes of December 13, 2005.

ACTION REQUESTED: Approve.

2.                   PROPOSITION 65 REPORT

SUBJECT: On December 11, 2005 Emergency Services Chief Chester Jackson received notification from Susanville Inter-Agency Fire Center that there was a gasoline fuel spill of about 175 gallons at the  California Highway Patrol Office, 472-400 Diamond Crest Road, Susanville.  CHP will contact a clean up contractor to mitigate and clean up the spill.   Lassen County Environmental Health was notified.

ACTION REQUESTED: Receive and file report #05-03, filed by Emergency Services Chief Chester Jackson, on December 12, 2005.

COMMUNITY DEVELOPMENT DEPARTMENT

2.                   PLANNING DIVISION

SUBJECT: Update on Washoe County Special Use Permit Applications for Fish Springs Ranch, LLC, Intermountain Water Supply LTD (Dry Valley), and the North Valleys Water Projects Final Environmental Impact Statement (EIS) for the Carson City Field Office of the Bureau of Land Management.  The projects consist of two separate water supply and transmission projects from Fish Springs Ranch LLC and Intermountain Water Supply  LTD (Dry Valley), to construct and operate water wells and pipelines in Washoe County, Nevada that are proposed to transmit groundwater from the Honey Lake Basin to the Stead/Silver Lake/Lemmon Valley areas north of Reno.

ACTION REQUESTED: 1)   Receive Report;

2)   Authorize Chairman or designee to sign letter containing Final EIS comments;

3)   Authorize Chairman to sign letter containing Intermountain Water Supply Use Permit application comments to Washoe County Planning Commission.
